If you have responsibility for a facility
subject to the CFATS Top-Screen process solely due to the new mixture rule
provisions for fuels, API has generated a
letter template that may be
useful for requesting an extension. As background, at the end of
November, DHS had verbally offered an extension for such facilities but
has since declined to grant a blanket extension. It is not presently
clear whether individual extensions to the January 22 top-screen filing
deadline will be granted.

On November 20, DHS
published its Final Appendix A to the Chemical Facility Anti-Terrorism
Standard Final Appendix A.

TWIC enrollment process. At this time, forms are available for the

TWIC
Enrollment Begins! TWIC enrollment begins on October 16, 2007 at the
Port of Wilmington, DE. Dates for enrollment of workers at other ports
have not been posted at this time. To obtain information on the
pre-enrollment and enrollment process, and other enrollment locations,
visit the Transportation Security Administration’s Web site at
http://www.tsa.gov/twic.
Canada will implement
Phase I of its Marine Transportation Security Clearance Program starting on
December 15, 2007. Phase I requires workers at the ports of Montreal,
Halifax, Vancouver, Fraser River, and North Fraser River, as well as the
control centers of the St. Lawrence Seaway Management Corporation to have

Section 306 of HR 2830, The Coast Guard
Reauthorization Act of 2007, states that each facility security plan shall
provide a system for seamen assigned to a vessel at that facility, pilots,
and representatives of seamen's welfare and labor organizations to board
and depart the vessel through the facility in a timely manner at no cost
to the individual. Click

The
Occupational Safety and Health Administration (OSHA) recently added a
Storage Tanks Module
to its Web site as part of the Oil and Gas Well Drilling, Service and
Storage area. The module is designed to address safety
requirements, standards and guidance for working in permit- and
non-permit required confined spaces in aboveground storage tanks.
As
reported in the August issue of ILTA News, the Buncefield Standards Task
Group (BSTG) recently issued its final report on the 2005 Hertfordshire

ARE YOUR
EMPLOYEES READY FOR TWIC? Terminals are responsible for ensuring that
employees are familiar with the TWIC program. While no enrollment
deadlines have been published, TSA has issued official notification flyers
on TWIC for employers to post in the workplace. These documents are
available in

and
Spanish.

2, USCG
published the final
Navigation and Vessel Inspection Circular No. 03-07
(NVIC) providing guidance on the Transportation Worker Identification
Certification Program (TWIC) final rule. More information on the TWIC

State of New Jersey is proposing a new
approach to control emissions from floating roof storage tanks.
The
City of Chesapeake, Virginia has
authorized a new storage tank permitting fee on all combustible or
flammable liquid tanks larger than 100,000 gallons claiming that the
revenues generated will be used to offset added costs of training and
equipment to prepare to respond to potential ethanol emergencies.
