ILTA Joins Industry Coalition in Letter to Congress Supporting California Waiver CRAs
On Thursday, September 3, ILTA joined a coalition of more than 70 industry organizations and associations in a letter to Speaker Johnson, Senate Majority Leader Thune, House Minority Leader Jeffries, and Senate Minority Leader Schumer, urging Congress to use its Congressional Review Act authority to disapprove of six California rulemakings. Dear Speaker Johnson, Minority Leader Jeffries, Majority Leader Thune, and Minority Leader Schumer:
Our organizations represent a broad coalition of stakeholders across the energy, manufacturing, agriculture, and transportation sectors. Collectively, our industries employ tens of millions of Americans that ensure our nation and others around the globe have the fuel, food, and equipment needed for our economies to thrive. We appreciate the bipartisan passage of the Advanced Clean Cars II, Advanced Clean Trucks, and Low Omnibus NOx Congressional Review Acts (CRA), which constrained California’s ability to ban the sale of new internal combustion engines and forced electrification of heavy-duty trucks. We now urge Congress to finish the job it started and to pass CRA resolutions on several remaining California rules aimed at limiting choice in vehicle and other engine purchasing decisions.
On June 12 and July 22, 2026, the Environmental Protection Agency (EPA) transmitted a total of six additional California waiver rules to Congress for consideration under the CRA: Advanced Clean Cars I, the reinstatement of Advanced Clean Cars I, the Small Off-Road Engine (SORE) Amendments, the Greenhouse Gas (GHG) Emissions, Commercial Harbor Craft, and Ocean-Going Vessels At-Berth. These waivers authorize California to restrict, and in the case of SORE, to ban the use of internal combustion engines. Each of these rules carries significant implications for consumers, fuel producers, equipment manufacturers, the maritime industry, and the broader U.S. economy. Policies of this magnitude should be decided by Congress, not a single state.
We strongly urge Congress to protect consumer choice by using its Congressional Review Act authority to disapprove these rule makings. Doing so will protect consumers, our economy, and our national security.
