Jay Cruz / Wednesday, August 27, 2025 / Categories: Government Affairs Brief Article ILTA Gasoline Distribution Challenge Petition Held in Abeyance Indefinitely As ILTA, API, and AFPM continue engaging the Environmental Protection Agency on their joint challenge to the 2024 final Gasoline Distribution Rule, the coalition has agreed to accept EPA and the Department of Justice’s offer to hold the combined Petitions for Judicial Review in abeyance indefinitely. While conversations with EPA remain productive, ILTA remains mindful of the rule’s impacts on capital project planning. Why It Matters: The EPA has stated it will formally respond to the joint Petitions for Reconsideration by early spring 2026, but ILTA is advocating to expedite this timeline. The rule, enacted under the previous Biden administration, imposes compliance costs amounting to hundreds of millions of dollars for the bulk liquid storage industry, making a meaningful rework of the rule critically important.
