President Trump Issues Executive Orders and Other Actions to Implement New Policy Priorities
In his first days in office, President Trump issued a series of executive orders and memoranda aimed at reversing Biden-era policies and advancing his administration’s key priorities. While these actions cover a broad range of issues, several have potential implications for ILTA members and the liquid terminal industry.
This is a summary of key executive actions, their impacts, and relevant directives. ILTA will continue to monitor and provide updates on policy changes affecting the industry in the coming months.
Initial Recessions of Harmful Executive Orders and Actions (Executive Order)
· Revokes 78 executive orders and memoranda issued by President Biden between January 20, 2021, and January 16, 2025.
· Following this order, an additional list of orders, memoranda, and proclamations issued by the Biden administration that should be rescinded should be submitted to President Trump, as well as a list of replacement orders, memoranda, or proclamations.
· Revoked actions include:
o Executive Order 14082 of September 12, 2022 (Implementation of the Energy and Infrastructure Provisions of the Inflation Reduction Act of 2022).
o Executive Order 13990 of January 20, 2021 (Protecting Public Health and the Environment and Restoring Science To Tackle the Climate Crisis)
o Executive Order 14057 of December 8, 2021 (Catalyzing Clean Energy Industries and Jobs Through Federal Sustainability).
o Executive Order 14008 of January 27, 2021 (Tackling the Climate Crisis at Home and Abroad)
Regulatory Freeze Pending Review (Presidential Memorandum)
· Prohibits issuing any federal regulations not already published in Federal Register until approved by Trump agency heads or designees.
· Immediately withdrawals of all rules sent to Federal Register but not yet published.
· Potentially extends compliance deadlines by 60 days for rules published in Federal Register that have not yet taken effect, with the possibility of opening a comment period to allow interested parties to provide comments about issues of fact, law, and policy, and consider reevaluating pending petitions involving such rules.
Unleashing American Energy (Executive Order)
· In general, sets forth broad policy statements, including encouraging energy exploration and production on federal lands, ensuring all regulatory requirements are grounded in law, and guaranteeing that all executive departments and agencies provide opportunity for public comment and rigorous, peer-reviewed scientific analysis.
· Calls for immediate review of all agency actions that impose undue burden on the identification, development, or use of domestic energy resources, including oil, natural gas, and biofuels.
· Revokes twelve energy and environment-related executive orders issued by President Biden.
· Directs agencies to provide guidance on and revise permitting regulations, including undertaking efforts to eliminate all delays within their respective permitting process.
· Calls for agencies to adhere to only the relevant legislated requirements for environmental considerations, including consideration of eliminating the “social cost of carbon” calculation from any Federal permitting or regulatory decision.
