Tracking State Legislation

A growing number of states are taking regulatory and legislative actions to restrict the use of PFAS in firefighting foams, increase greenhouse gas (GHG) reporting mandates, and establish zero-emission vehicle (ZEV) truck regulations. ILTA maintains an online database tracking these developments to enable terminal companies to remain up-to-date with these rapidly evolving policy environments. ILTA will continue to monitor state actions and will update this resource on an ongoing basis.

Safely Transitioning from PFAS Firefighting Foams at Liquid Terminals with Protection for Operators

ILTA supports the safe and rapid transition to PFAS-free firefighting foams (AFFF), balancing fire safety, human health, and environmental considerations. Bulk liquid terminal companies, as good actors, have used AFFF in their hazard prevention and protection operations for several decades to meet federal safety regulations. As such, while the public sector, private sector, and federal government all source and implement alternative foams that do not contain PFAS at the facilities, terminal companies should receive federal liability protection for PFAS remediation under the Comprehensive Environmental Response, Compensation, and Liability Protection Act (CERCLA) of 1980.

Tracking Environmental Policy for Terminal Operators

ILTA wants to keep its membership informed on different environmental policies emerging at the state level, particularly targeting GHG reporting and ZEV mandates.

A current list of state actions taken to date regarding GHG reporting can be found here. A historical list of state actions taken from 2020-2025 regarding GHG reporting can be found hereA current list of state actions taken to date regarding ZEV mandates can be found here.
